Magistrate ruled that a girl liked and enjoyed s*xual encounters with Kombi driver & her boyfriend


A 22-year-old commuter omnibus driver who was facing charges of raping a school girl in a city graveyard has been acquitted after a Masvingo Magistrate Court ruled that the girl liked and enjoyed the s*xual encounters.

Steven Tsvairai had in his defence accused the girl’s parents of forcing her to report him to the police because he was a middleman between her and her boyfriend, Pride Rugora who disappeared when the case was reported.

The allegations against Tsvairai are that sometime in February 2013, he picked up the complainant from school and took her to a nearby bush and had s*xual intercourse without her consent. Tsvairai had two other encounters with the complainant but with her consent.

Magistrate Collet Ncube said the complainant did not report earlier because she liked Tsvairai.

Giving evidence in court, Sarah Mandizvidza, a general nurse at Masvingo Provincial Hospital testified that an examination of the complainant showed that she was s*xually active. The complainant was not only abused by Tsvairai. She was also abused by Pride Rugora who stayed with her for three days
